Welcome to protectthebasin.org (the “Site”), operated by Protect the Basin (“Protect the Basin,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of the Site. By using the Site, you agree to these Terms. If you do not agree, do not use the Site.
Protect the Basin is a public-education and advocacy campaign supported by Fasken Oil & Ranch and Livlen Media. The Site is provided for informational and advocacy purposes. We are not a law firm, accounting firm, regulator, or government agency, and nothing on the Site constitutes legal, financial, scientific, or professional advice.
The Site is intended for adults age 18 or older. By using the Site you represent that you are at least 18 and have the legal capacity to enter into these Terms.
We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for your personal, non-commercial information and to participate in our advocacy activities (such as signing petitions and sending messages to elected officials). All other uses require our prior written permission.

We may suspend or terminate your access to the Site at any time for any reason, including violation of these Terms
If you sign a petition, submit a comment, send a message to a policymaker through the Site, or otherwise submit content to us (“Submissions”), you grant Protect the Basin and its affiliates a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, display, distribute, and create derivative works of your Submission for the purposes of the campaign. This includes aggregating and reporting petition counts, sharing your Submission with the intended recipient (for example, a member of Congress), and quoting it in advocacy materials, news releases, and on the Site, consistent with the Privacy Policy.
You represent that each Submission is your own, is accurate, and does not violate any third party’s rights or any law. You are responsible for your Submissions.
We are not obligated to publish, retain, or use any Submission and may remove or decline Submissions at our discretion.
All content on the Site that is not a Submission – including text, graphics, logos, photographs, videos, data compilations, design, and code – is owned by Protect the Basin, its affiliates, or its licensors and is protected by U.S. and international intellectual property laws. The “Protect the Basin” name, logo, and related marks are trademarks of Protect the Basin or its affiliates. You may not use them without our prior written permission, except for fair, descriptive use in news reporting or commentary with appropriate attribution.
You may share links to public pages of the Site and quote brief, attributed excerpts for news, commentary, education, or other fair-use purposes.
The Site may include links to third-party websites, embedded media, or content from third parties (for example, news articles, agency filings, social media posts, or partner organizations). These links and content are provided for convenience and reference only. We do not control, endorse, or assume responsibility for third-party content, and your interactions with third-party sites are governed by their own terms and privacy policies.
Information on the Site is provided for general public-education purposes. It is not legal, regulatory, scientific, engineering, environmental, financial, or other professional advice and should not be relied on as a substitute for advice from a qualified professional. We make no representation that information on the Site is current, complete, or applicable to your situation.
Protect the Basin engages in public education and grassroots advocacy. Nothing on the Site is intended as, and should not be construed as, a contribution to any candidate, political party, or political committee, or as an expenditure on behalf of any candidate. References to public officials are provided for advocacy and educational purposes.
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY INFORMATION ON THE SITE IS ACCURATE, COMPLETE, OR CURRENT.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL PROTECT THE BASIN, ITS AFFILIATES, OR ITS OR THEIR DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; IN THOSE JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW
You agree to defend, indemnify, and hold harmless Protect the Basin, its affiliates, and its and their directors, officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with (a) your access to or use of the Site, (b) your Submissions, or (c) your violation of these Terms or any applicable law.
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Midland County, Texas, and you consent to the personal jurisdiction of those courts. You waive any objection to venue in those courts.
We may update these Terms from time to time. When we do, we will revise the “Effective” date above and post the updated Terms on the Site. Your continued use of the Site after the Terms are updated constitutes your acceptance of the updated Terms.
We may suspend or terminate your access to the Site at any time, with or without notice, for any reason. The provisions of Sections 5 (Submissions), 6 (Intellectual Property), 10 (Disclaimers), 11 (Limitation of Liability), 12 (Indemnification), 13 (Governing Law), and 16 (Miscellaneous) survive termination.
These Terms, together with the Privacy Policy, are the entire agreement between you and Protect the Basin regarding the Site. If any provision is held unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce a provision is not a waiver of that provision. You may not assign these Terms; we may assign them in connection with a reorganization, merger, or transfer to a successor.
