Fight against nuclear waste may head to Supreme Court

A fight to prevent high-level radioactive waste at a site near Andrews may be headed to the U.S. Supreme Court.

Waste Control Specialists and the Nuclear Regulatory Commission have appealed to the nation’s highest court last year’s ruling from the U.S. Fifth Circuit Court of Appeals that vacated the license to receive, possess, transfer and store up to 5,000 metric tons of spent fuel and 231.3 metric tons of Greater-Than-Class C low-level radioactive waste for 40 years on property at the existing Waste Control Specialists low-level radioactive waste disposal site. Holtec, which sought a similar license for a location in southeastern New Mexico, is expected to appeal by the deadline on June 25.

Monica Perales, in-house counsel for Fasken Oil & Ranch, said she doesn’t think the Supreme Court will take up the case.
